Terms of Service

Effective Date: January 1, 2026 • Last Updated: 2026

1. Acceptance of Terms

These Terms of Service ("Terms") govern your purchase, download, and use of the D3 HTML to Video software application ("Software") provided by D3 Motion Engine ("Company," "we," "us"). By purchasing, downloading, installing, or executing the Software, you agree to be bound by these Terms and our License Agreement.

2. Software Description & Local Operation

The Software is an offline desktop utility designed to convert web animations (HTML, CSS, SVG, Canvas, JavaScript) into video formats (such as MP4) on the user's host operating system. The Software runs locally on your computing hardware and does not transmit project files or rendered videos to Company servers.

3. License Grant

Subject to full payment of the one-time license fee, the Company grants you a perpetual, non-exclusive, non-transferable license to install and operate the Software on up to three (3) personal or business computers in accordance with our License Agreement.

4. User Content & Intellectual Property

You retain all ownership, intellectual property rights, and commercial copyright in the HTML content, scripts, and media files you process through the Software, as well as the resulting rendered video files. We claim no ownership, license, or rights in your output media.

5. Prohibited Conduct

You agree not to:

  • Reverse-engineer, decompile, or disassemble the proprietary application wrapper except where permitted by applicable mandatory law.
  • Resell, distribute, rent, lease, or sub-license your license key or copy of the Software to third parties.
  • Use the Software to convert or generate content that violates intellectual property laws, defamatory material, or malicious code.

6. Disclaimer of Warranties

THE SOFTWARE IS PROVIDED ON AN "AS IS" AND "AS AVAILABLE" BASIS, WITHOUT WARRANTY OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO THE IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT. THE COMPANY DOES NOT WARRANT THAT THE SOFTWARE WILL BE UNINTERRUPTED, ERROR-FREE, OR COMPATIBLE WITH EVERY USER-CREATED JAVASCRIPT ANIMATION OR ARBITRARY WEB SCRIPT.

7. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, IN NO EVENT SHALL THE COMPANY BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES (INCLUDING LOSS OF PROFITS, DATA LOSS, OR BUSINESS INTERRUPTION) ARISING OUT OF OR IN CONNECTION WITH THE USE OR INABILITY TO USE THE SOFTWARE. IN ALL CIRCUMSTANCES, THE COMPANY'S TOTAL AGGREGATE LIABILITY SHALL NOT EXCEED THE AMOUNT PAID BY YOU FOR THE SOFTWARE LICENSE.

8. Digital Product & Non-Refundable Policy

D3 HTML to Video is a digitally delivered software product. Due to the immediate delivery of digital files, license keys, and perpetual offline software functionality, all purchases are final, non-cancellable, and strictly non-refundable. Please review our License Agreement and explore our online interactive motion demo before completing your order.

9. Amendments & Contact

We reserve the right to modify these Terms periodically. Continued use of the Software after notice of modifications constitutes your acceptance. For questions regarding these Terms, contact our legal team at support@d3motion.app.
